Law No. 6/2018 of 22 February establishes the Statute of the Mediator of Recovery of Companies, establishing the requirements and conditions for access to this activity.
The official lists of mediators are published by “IAPMEI - Agência para a Competitividade e Inovação, I.P.”, responsible for supervising the exercise of the activity.
The Mediator of Recovery of Companies will be responsible for assistance a debtor company in a difficult economic or insolvency situation and in negotiation with its creditors with a view to performing a restructuring agreement aimed at recovering the company. The Mediator assist and participate in the execution of a proposal for a restructuring agreement, with the sole purpose of assisting the debtor in his extrajudicial recovery.
The afore-mentioned Law no. 6/2018 of 22 February has entered into force on 23 February 2018.
