Presidential Decree No. 91/18 of April 10 2018 approved the Rules and Procedures for the Abandonment of Wells and Dismantling of Oil and Gas Facilities in National Territory, which is applied to the abandonment of wells and dismantling of used facilities in oil operations carried out on land and offshore, in accordance with the Law on Petroleum Activities, as approved by Law no. 10/04, of 12 November 2014. This law is part of the legislative package for the oil and gas sector.
Pursuant to its Article 2, this Presidential Decree does not apply to the dismantling of facilities used for the crude oil refinement, transportation, logistics, distribution and commercialization of petroleum products.
The entities under contract must submit to Sonangol, herein acting as national concessionaire, a provisional abandonment plan, including the environmental impact study, being, in the case of decommissioning, such operation be total or partial - in the latter, an authorization from the supervisory body must prior requested to the conduction of the relevant operation.
The contracting entities must provide the necessary funds for the abandonment of the wells and dismantling of facilities, and should also take into account all aspects deemed necessary to avoid incidents or accidents during or after the dismantling of facilities.
This Presidential Decree entered into force on the day of its publication, applying to all petroleum concessions, from the financial year following its entry into force.
